Wings-of-Art, a wholly-owned subsidiary of Wings of Wind provides a service for viewing, selling and purchasing original works of art through our website, accessible at www.wings-of-art.com (the “Site”) with any services, software, tools, features or functionality made available by Wings of Art. Please read carefully the following terms and conditions and our Privacy Policy, which may be found at www.wings-of-art.com/terms of services. These Terms, the Privacy Policy, and any other policies linked to herein, govern your access to and use of the Services, and constitute a binding legal agreement between you and Wings of Art.

General Terms
The artworks made available for sale on the website may not always be in the physical possession of Artworks and may be physically located anywhere in the Bangladesh.
All artworks made available for sale on the website will be sold at the price listed and no discounts will be granted to the buyer. The price of the artwork listed does not include duties, taxes, shipping and handling, which will be charged as applicable and would depend on the shipping address provided by the buyer. The information provided during registration or amended at the time of finalizing a purchase shall be the final billing address and shipping address for delivery of the artworks.
The buyer agrees that the buyer is liable for any duties and taxes that might be applicable on the purchase such charges shall be payable in addition to the price of the artwork.
All invoices will be raised by Wings of Wind based on the registration information provided by the buyer or amended at the time of finalizing a purchase and payments will be accepted only from the buyer so registered. In the event that a payment is sent from elsewhere, it may either be returned or could result in a delay in the processing of the order until management decides whether a variation from the registration details may be accepted.
Placing an order on www.wings-of-art.com constitutes an irrevocable acceptance of the purchase. Unless rescinded/cancelled by Wings of Wind within 2 working days on account of a default by the seller or any prior or continuing breach by the buyer, such acceptance results in an enforceable contact of sale. The contract of sale is between Wings of Wind (Acting as the agent of the Seller) and the buyer.
Once an order is placed on Wings of Wind the buyer is required to make payment for the price of the artwork as well as the charges referred to above within 7 working days from the date of placing the order. In the event that Wings of Wind does not receive payment within 7 working days it reserves the right to cancel the order without prior notice to the buyer. Alternately, and without prejudice to the foregoing, Wings of Wind may, at its absolute discretion, hold the artwork for the Buyer and charge any storage and insurance costs applicable on the purchase and/or may seek to commence legal proceedings (acting as the agent of the Seller) to ensure execution of the contract of sale.
The artworks will be delivered/shipped to the Buyer once all necessary documentation, relating to transportation, tax, etc. as may be reasonably requested for by Wings of Wind are completed and payment has been realized in full including any additional charges. Transit insurance costs will be included in such additional charges, unless specifically advised otherwise by the Buyer. In the event that the buyer chooses to himself collect the artworks from Wings of Wind he must do so within two weeks of Wings of Wind receiving the payment. In the event that the artworks are not so collected within a period of two weeks, storage and insurance costs will be applicable on the purchase and will be determined at the complete discretion of Wings of Wind.
You agree to abide by all provisions prescribed in these terms and conditions. In particular, you warrant that all information that you submit will be true and accurate (including without limitation your credit card number and expiration date), and you agree to pay all costs, charges plus all applicable taxes for the purchases made by you.
Wings of Wind is authorized by the Sellers to exercise complete discretion in (i) the illustration and descriptions of art works for viewing and sale and (ii) acceptance or rejection of orders received.
All artwork displayed on the Website is supported by an authenticity guarantee from the Seller. Based on this, Wings of Wind will issue a specific authenticity guarantee for every artwork sold on the Website.
Wings of Wind is not obligated to provide any physical preview of the artwork either before or after the sale. Wings of Wind is in no way liable for the condition of the artwork. Condition reports are provided on request and are based on the information provided by the Seller. In the event that Wings of Wind is of the view that there is a significant difference in the physical work relative to its appearance as displayed on the website, an email will be sent to the buyer regarding the difference and Wings of Wind will await the buyer’s decision to proceed with the order.
All foreign currency exchange rates for the purchase are made based on the USD:BDT forex rate prevailing on the day of confirmation of order. The prices for individual artworks have been ’rounded off’ for ease of reference and do not necessarily reflect the exact exchange rate that will be used for calculation of the invoiced price.
The buyer warrants that all the information furnished at the time of registration is true and correct and any change in the information provided will be updated and intimated to Wings of Wind immediately. Wings of Wind is entitled to act on the basis of the information provided and seek such further information, clarifications or verifications as it may deem necessary for granting registration. Such registration may be suspended or cancelled where Wings of Wind forms a reasonable view that any of the above information may be inaccurate. However, such registration will be restored immediately on the buyer furnishing information to the satisfaction of Wings of Wind.
All artworks made available for sale on the website will be sold at the price listed and no discounts will be granted to the buyer. The price of the artwork listed does not include duties, taxes, shipping and handling, which will be charged as applicable and would depend on the shipping address provided by the buyer. Modifications to these Terms
Wings of Art reserves the right, at its sole discretion, to modify, discontinue or terminate the Services or to modify these Terms, at any time and without prior notice. If we modify these Terms, we will post the modification on the Services or provide you with notice of the modification. We will also update the “Last Updated Date”. By continuing to access or use the Services after we have posted a modification on the Services or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using the Services. We encourage you to check back regularly to review these Terms.
Modifications to the Services
We reserve the right to change the URL, modify or discontinue, and restrict or block access to, the Services without notice to you. We may modify or remove any Original Works of Art Wings of Art Content from the Services at any time without notice to you, including the removal of any works of art or content that we believe to be obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable.
Occasionally, there may be information on the Services that contains typographical errors, inaccuracies or omissions. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information if any such information on the Services is inaccurate at any time without prior notice. We undertake no obligation to update, amend or clarify information in the Services, except as required by applicable local, state, federal or international laws, regulations, or statutes. No specified update or refresh date applied to the Services should be taken to indicate that all information on the Services has been modified or updated.
Occasionally, there may be information on the Services that contains typographical errors, inaccuracies or omissions. Eligibility
The Services are intended solely for persons who are 18 or older. Any access to or use of the Services by anyone under 18 is expressly prohibited. By accessing or using the Services you represent and warrant that you are 18 or older.
Color
You understand and agree that Wings of Art uses commercially reasonable efforts to display the colors of Original Works of Art accurately via the Services. However, because individual computer monitors may display colors differently, Wings of Art is not responsible for the color accuracy of any Original Works of Art displayed on the Services, and disclaims all liability in this regard.
Notices
Any notices or other communications permitted to required hereunder, including those regarding modifications to these Terms, will be in writing and given: (i) by Wings of Art via email (in each case to the address that you provide) or (ii) by posting to the Services. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.
